CONDITIONS OF SUPPLY
The supply of goods by MODEST, (the seller) shall be subject to and conditional upon acceptance of the following terms and conditions. Where there is any conflict between these conditions and any proposed by the buyer of the goods (the buyer) these terms and conditions shall apply. Any condition which the buyer wishes to apply on any supply of goods must be specifically agreed in writing by the seller.
PRICES
All prices quoted by the seller are subject to alteration without notice unless otherwise expressly agreed in writing by the seller or stated expressly in the form of tender issued by the buyer.
VALUE ADDED TAX
All items are subjected to Value Added Tax in UAE. Prices quoted by the seller are exclusive of VAT which shall be charged on invoices at the rate in force. The tax status of the buyer shall be a matter between the buyer and the appropriate tax authority.
DAMAGE OR LOSS OF GOODS
Responsibility for damage to or loss of goods in transit prior to the passing of the risk in the goods will only be accepted by the seller if the buyer notifies the seller within 24 hours of delivery. Claims for shortages or damage will not be accepted after a clear receipt has been given to the seller. If goods cannot be examined on delivery, delivery sheets or documents presented to the buyer should be signed “Unexamined” and any damage or shortage discovered after examination of the goods notified in writing to the seller within 24 hours after delivery.
PAYMENT TERMS
Payment, unless otherwise specifically agreed in writing between the seller and the buyer, where the goods are supplied on credit, which will be due upon the agreement between the buyer and seller from the date of the seller’s invoice. Failure on the part of the buyer to pay the seller’s invoices in the time stated may result in the seller taking appropriate action to recover the debt, or suspension of the buyer’s authority to purchase goods or services from the seller.
ORDERS
All cash purchase orders will be processed upon receipt of payment. MODEST will not be held accountable for any delays or non-delivery of goods without accepted payments. All products listed online are currently available for delivery or collection. In the rare instance that products are not immediately available, the seller will ensure to notify the buyer of any issues. Please note that certain product lines are not available (if out of stock) due to international delivery. Any changes to the product specification or packaging will be made known to the buyer prior to placing orders. Any orders not fully confirmed by the buyer in this instance will be cancelled and any money issued shall be returned. Once orders have been processed, buyers will receive an email confirming the order. The seller reserves the right to refuse an order at their absolute discretion and without explanation.
REFUNDS AND RETURNS
Items are entitled to be credited, refunded or returned upon receipt of payment and must be made within 7 days of purchase. Any item damaged during delivery is accepted by the seller, and will be replaced free of charge within 48 hours upon receipt of damaged goods to the store’s address provided. Refunded goods must be returned in a sellable and unused condition and including their original packaging. All accepted refunds will be made by original payment method. Buyers returning goods to the store will be entitled to an immediate refund. Any goods returned by courier may take up to 5 working days for refunds to be processed. Courier charges for any returns made will not be credited. We would advise our buyers who return items by courier to obtain certificate of courier. Exchanges are granted on a case-by-case basis. Buyers are encouraged to take into account descriptions of items they are purchasing; it is your own responsibility to ensure all products and services meet your specific requirements.
